1. Introduction

This is the privacy policy (“Privacy Policy”) that governs how Cowbell Cyber, Inc. (“Cowbell”, “we”, “our” or “us”), use Personally Identifiable Information (“PII”) (defined below) that we collect, receive and store about you in connection with your use of our website https://www.cowbell.insure (collectively, the “Site”) and the Service, as defined in Cowbell’s Terms of Service, located at https://cowbell.insure/terms (the “Terms”). Any references made in this Privacy Policy to “Cowbell” shall be deemed to have been made to Cowbell Cyber, Inc., its subsidiaries, successors, assignees, and affiliates, as well as any company that controls Cowbell, directly or indirectly, and any other subsidiary of that controlling company. Cowbell’s family includes various subsidiaries that are licensed and appointed to represent Cowbell in each state in which Cowbell insurance is sold. Except as otherwise defined, each capitalized term in this Privacy Policy shall have the meaning given such term in the Terms.

You may choose whether to provide or disclose some of the elements of PII in connection with your use of the Site or the Service. If you choose not to provide the PII we request, you may still visit and use parts of the Site or the Service, but may be unable to access or use certain features, options, programs, and services. The Site and the Service may contain links to third-party websites and services that are not owned or controlled by Cowbell. We are not responsible for the privacy practices or the content of third-party websites, services and advertisements, and you visit them at your own risk. As used in this Privacy Policy, “PII” means any information that may be used, either alone or in combination with other information, to personally identify an individual.

2. Changes to this Privacy Policy

We reserve the right, at our discretion, to change the terms of this Privacy Policy at any time. You can see when this Privacy Policy was last updated by reviewing the “Last Updated” legend on the top of this page. We may provide you with notice of material changes to the Privacy Policy as appropriate under the circumstances. UNLESS OTHERWISE INDICATED, ANY CHANGES TO THIS PRIVACY POLICY WILL APPLY IMMEDIATELY UPON POSTING TO THE SITE.

3. What PII Do We Collect?

3.1. PII You Provide to Us. We collect PII from you when you register on the Site or for the Service. When registering on the Site or for the Service, as appropriate, we may collect the following PII: name, e-mail address, company information, mailing address, phone number, resume and applicant information (in the case of job applicants) and any communications you send to us.

3.2. PII Collected Automatically. We may collect PII automatically when you use the Site or the Service. We use Google Analytics on the Site to help us analyze the traffic on the Site. 4. What Purposes Do We Use PII For?

Any of the PII we collect about you may be used in one of the following ways:

  • To improve the Site or the Service;
  • To improve customer service;

5. How Do We Protect PII About You?

We implement a variety of security measures to maintain the safety of PII when you enter, submit, or access PII about you. We follow generally accepted industry standards to protect the PII submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect PII, we cannot guarantee its absolute security.

6. Do We Use Cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser. Cookies enable the sites or service providers systems to recognize your browser and capture and remember certain information.

We use cookies to help us remember and process your transactions, understand and save your preferences for future visits and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors.

7. How We Disclose PII

7.1. Third Party Providers. We transfer PII to our third party service providers that perform tasks on our behalf, and that assist us in providing the Site and the Service (for example, providing or maintaining databases or processing payments). We may also share PII with insurers, reinsurers, brokers, underwriters, insurance reference bureaus, motor vehicle record lookup services, medical service providers, fraud detection agencies, loss adjusters, lawyers, accountants, and others involved in the underwriting and claims handling process. These providers may collect PII about you in performing their services and/or functions related to the Site and the Service. We use commercially reasonable efforts to only engage or interact with third party service providers and partners that post a privacy policy governing their processing of PII. Notwithstanding the foregoing, we will comply with applicable laws regarding PII transfers as well as any transfer restriction that is specified in an agreement between Cowbell and a customer.

7.2. In the Event of Merger, Sale, or Change of Control. We may transfer or assign this Privacy Policy and any PII to a third party entity that acquires or is merged with us as part of a merger, acquisition, sale, or other change of control.

7.3. Social Media Plugins.  The Site uses social media plugins (e.g., Twitter) to enable you to easily share information with others.  When you visit the Site, the operator of the social media plugin can place a cookie on your device, enabling that operator to recognize individuals who have previously visited the Site.  If you are logged into the social media website while browsing the Site, the social media plugins allow that social media website to share PII about your activities on the Site with other users of their social media website.  We do not control any of the content from the social media plugins.  For more information about social plugins from other media websites you should refer to those sites’ privacy and data/information sharing statements/policies.]

7.4. Other Disclosures. We may disclose PII about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our terms of use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Cowbell, our users, or the public.

8. User-Generated Content

The Site or the Service may provide online forums through various potential functionalities, including messaging, comments, chat rooms, blogs, and other similar mechanisms. Cowbell does not have any control whatsoever over the user-generated content contained in such a forum provided on the Site or through the Service and will bear no liability for the content’s accuracy, suitability, legality, or inoffensiveness. Cowbell bears no responsibility or obligation to monitor user-generated content but nevertheless reserves the right to remove or edit user-generated information for any reason whatsoever. 9. Third Party Links

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of the Site and the Service and welcome any feedback about these sites.

10. How We Respond to Do-Not-Track Signals

Cowbell does not track Site users’ web browser information. Accordingly, we do not currently respond or take any action with respect to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of PII about an individual consumer’s online activities over time and across third-party websites or online services.

11. Security

To ensure that your information is secure, we have put in place commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect on our Site and through the Service. Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically on our Site or through the Service, and transmission of such data is therefore entirely at your own risk.

12. Accessing and Updating Your PII

You may access, correct, or request deletion of your PII by logging into your account or contacting us at cevinpl@pbjoryyplore.nv. We will try to respond to your request within a reasonable timeframe. Please be aware that even after we have processed your request for such a change, we may retain certain residual information in the backup and/or archival copies of our database.

In the event you close any account in connection with the Service, your account will be deactivated and your name and other PII will no longer be accessible by you. We may retain your PII for as long as your account is active or to provide you services, improve the Site or the Service, comply with our legal obligations, resolve disputes and enforce our agreements.

13. Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of PII about you by Cowbell to third parties for the third parties’ direct marketing purposes. 14. Children’s Privacy

The Site and the Service is not intended for children under the age of 18. Accordingly, we do not intend to collect PII from anyone we know to be under 18 years of age.
